Terms of Service

By accessing or using marqx.ai or the MarqX platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services. If you are using our services on behalf of an organisation, you represent that you have authority to bind that organisation.

MarqX provides a unified enterprise AI platform comprising data unification, workflow automation, reconciliation, AI agent deployment, and governance tools. Specific features and modules available to you depend on your subscription or engagement agreement.

You are responsible for maintaining the confidentiality of your account credentials, for all activity that occurs under your account, and for ensuring all users of your account comply with these Terms. Notify us immediately of any unauthorised access.

You agree not to:

MarqX owns all intellectual property rights in the platform, software, documentation, and branding. Your data remains your property. You grant MarqX a limited licence to process your data solely to deliver the services.

Enterprise customers receive service levels as specified in their order or engagement agreement. Our standard SLA targets 99.9% monthly uptime for the core platform. Credit mechanisms for downtime below the SLA target are specified in the enterprise agreement.

Fees are as specified in your order or engagement agreement. Platform subscriptions are billed monthly or annually in advance. Professional services engagements are billed per the agreed payment schedule. All fees are exclusive of applicable taxes.

Each party agrees to keep the other's confidential information (marked as such or reasonably understood to be confidential) confidential, and to use it only as necessary to fulfil obligations under these Terms.

Where we process personal data on your behalf as a data processor, we do so in accordance with your instructions and applicable data protection laws. Our Data Processing Agreement is available on request.

To the maximum extent permitted by law, MarqX's total liability to you for any claims arising from these Terms or the services shall not exceed the fees paid by you in the 12 months preceding the claim. In no event shall either party be liable for indirect, consequential, incidental, or punitive damages.

Either party may terminate a subscription on written notice per the terms of the order agreement. MarqX may suspend or terminate your access immediately if you breach these Terms. Upon termination, we will provide a data export for 30 days before deletion.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

We may update these Terms from time to time. Material changes will be communicated with at least 30 days' notice. Continued use of our services after the effective date constitutes acceptance.
